We can assist you to negotiate your property dispute in consultation with your legal representative.
We do not provide legal advice.
We can help you negotiate the issues in dispute, between yourselves, after you have obtained initial legal advice. The benefits in using a dispute resolution practitioner at this point include:
- no long drawn out court process
- cost effective
- you make the decisions based on win/win principles
If you reach agreement, you return to your legal representatives, who conduct the legal requirements, to formalise and finalise your agreement.
Under the
Family Law Act 1975 rules (13.04 and 12.02) regarding financial disputes you are required to make full and frank disclosure of all sources of earnings, interest, income, property and other financial resources, and any information about any property disposal that was made in the year immediately before or since separation.
Therefore when undertaking Family Dispute Resolution, any agreement you reach, regarding financial matters, must comply with the
Family Law Act 1975.
